We are writing to union members to inform them of a compensation program. If you are a current former worker or you know someone that is currently working or
previously worked in the United States Atomic Weapons industry for Department of Energy, this an important program for which
federal compensation and payment of medical expenses may be available.
The Energy Employees Occupational Illness
Compensation Program Act (EEOICPA) was enacted to provide compensation and medical benefits to current or former civilian
employees who worked at certain government or privately owned facilities where atomic weapons were produced or tested. Part B of the EEOICPA provides lump sum
benefits up to $150,000 to qualified claimants who are determined to have worked
at a covered facility and developed a radiogenic cancer, beryllium disease, or silicosis.
Qualified survivors of these covered deceased workers may also be eligible for compensation. See the backside of this flyer for coverage facilities.
Part E of EEOICPA provides benefits
to contractor and subcontractor employees who worked at certain government owned facilities where atomic weapons were produced
and developed an occupational illness as a result of exposure to toxic substances. While
the amount of compensation varies under this program, most employees found to have a work related illness will receive a federal
payment and medical benefits for the treatment of the covered condition. Survivors
of deceased employees are eligible to receive compensation, if it is determined that the employee’s death was linked
to exposure to toxic material at their place of employment.
As of March, 2008, the U.S. Department of Labor has paid out over $84 Million
in California alone in compensation and medical benefits
to nuclear weapons workers or their survivors under Part B and Part E. The U.S.
Department of Labor has paid out over $3 Billion nationwide.

DOE facility or know of someone who worked at a DOE facility or would like information about the requirements of the law and
assistance with the completion of necessary forms, please contact the Resource Center.
If you had previously filed under Part B, you need to file under Part E in order to receive consideration under
the Part E compensation program. If you have been denied under Part B you may
be eligible for compensation under Part E.
